Compliance with UK Borders Agency Requirements
There are new legal obligations on the University as an employer to monitor and report cases of unauthorised absence of members of staff who are subject to immigration control, i.e. those requiring special permission to live and work in the UK.
In order to comply with the special requirements of the Home Office, as a Sponsoring Organisation under the Points Based System for Immigration the University must report cases of unauthorised absence to the Home Office immediately, and in any event, within 10 working days.
It is essential that we fully comply with this new requirement as failure to do so could quickly result in withdrawal of the University's Sponsorship Licence. In that event, we would no longer be permitted to recruit staff from overseas.If you manage or supervise staff, there are some simple next steps that you should now take:
- Ensure that all staff responsible for managing groups of employees are aware of their responsibility for checking attendance and reporting unauthorised absence. This includes when staff are working off-site.
- Ensure that guidelines for reporting absence are clear and made available to staff at all levels.
- Record all occurrences of absence, for whatever reason, within your department, and ensure that records are accurate and up to date.
- Report immediately all potential or actual unauthorised absences to your Faculty/Divisional Human Resource Manager immediately, who will take the appropriate action.
