Current Research

Benjamin is currently reading for an M.Jur which examines the approach of the domestic courts to the use of Strasbourg jurisprudence in adjudication under the Human Rights Act. The thesis will examine the main approach of the courts to the obligation to ‘take into account’ the case law of Strasbourg. It will consider the criticisms that have been mounted against this approach by both the academic and judicial community and whether the approach of the courts can be supported as the most appropriate approach.
