The following calendar of 116 charter texts hitherto unknown to historians of Colchester relates to properties purchased in Colchester in 1485 by Henry Colet, citizen and alderman of London. His acquisition is recorded in deeds 114-16 below. From 1510, these properties formed part of the endowment of St Paul's School by Henry's famous son John, dean of St Paul's. The cartulary in which the texts survive records the title deeds relevant to that endowment, which was administered by the Mercers' Company. The existence of this interesting collection was drawn to my attention by Dr. Anne Sutton, the historian of the Mercers' Company, who kindly supplied me with a xerox copy of the original manuscript folios. For these and other details about the cartulary, see her article 'Malory in Newgate: A New Document', The Library, 7th series, I, no. 13 (2000), pp. 243-62, which also discusses in detail items 111-16 below.

In the calendar a charter is described as an enfeoffment when it is alienated in perpetuity ‘to hold of the chief lords’ and as a subenfeoffment when it is alienated in perpetuity to be held of the grantor and his heirs. The calendar says the grantor ‘has granted’ without comment where the formula of the charter uses the verb sequence concedere, dare (or dare, concedere), confirmare; formulae using other verbs are indicated. A charter is described as a quitclaim where the sole object of the instrument is for the grantor to abandon right in a property. The corresponding calendar says the grantor ‘has quitclaimed’ where the formula of the charter uses the verb sequence remittere, relaxare, quietum clamare; formulae using other verbs are indicated.

Carta Emme quondam vxoris Roberti filii sacerdotis vidua Alicie et Juliane filiabus Rogeri de Sancto Edmundo de tribus acris terre cum pertinentiis in suburbis Colcestr’.

Subenfeoffment with warranty. Emma widow of Robert priest’s son of Colchester (filius sacerdotis de Colchestr'), has granted in pure widowhood to Alice and Juliana, daughters of Roger of Bury St Edmunds, weaver, of Colchester 3 acres of arable in the suburbs of Colchester which Robert left to Emma in his will, lying between land of Sir Robert fitz Walter called Edrichescroft on the east side, and land of Henry Prentiz on the west side, extending from land of Robert son of Simon de Fossato, chaplain, which Emma sold him, to the north as far as the king’s highway leading from Colchester to the stone cross to the south; to hold from Emma and her heirs, for an annual rent of a gillyflower (vnum clauum gariofili) each Easter for all service, and paying 100s as an entry fine.

Subenfeoffment with warranty. John of Ongar has granted to Robert priest’s son of Colchester 1 acre of arable in the suburb of Colchester between John’s land and Robert’s land, extending from the king's highway leading from Colchester as far as the stone cross as far as Robert’s land that was once Melyor’s; to hold of John and his heirs for an annual rent of a root of ginger at Easter and paying 30s as an entry fine.

Subenfeoffment with warranty. Robert son of Simon de Fossato of Colchester, chaplain, has granted to John of Stanway, burgess of Colchester, 2 acres of arable in the suburbs of Colchester in the field called Bradestan which were of once of Henry parmenter (permentarius) of Northstrate, which Robert bought from Emma widow of Robert priest’s son of Colchester, and which the same Robert bequeathed to her by his will, lying between meadow once of Master Richard of Peldon on one side, and land of the said John which was once of Gonnor daughter of Henry Friday on the other; to hold from Robert and his heirs, for an annual rent to the heirs of Henry parmenter (p’mentarius) of Northstrate and his heirs of a pair of gloves price ld, or ld at Easter, and to Robert and his heirs of a root of ginger at the Nativity of St John the Baptist, and paying 4 marks as an entry fine.

John clerk, son of Adam of ‘Brundale’, has granted to Thomas of ‘St Audomar’ 1½ perches of arable which lie next to Ningneacres to the east (que iacet iuxta Ningneacres proximo loco versus orientem); to hold of John and his heirs for an annual rent of l½d at the Nativity of St John the Baptist, paying 16s as an entry fine.

Enfeoffment (perpetual rent) with warranty. Subenfeoffment with warranty. John Boloygne, rector of the church of St Runwald, Colchester, has granted to Richard of Copford, burgess of Colchester, and his wife Richolda, for a sum of ready money, 2 acres of enclosed arable lying in the suburb of Colchester in the field called Elmfeld between land formerly master John of Colchester’s on the north side and land formerly Richard Pruet’s on the south side, and extending from the king’s land called Sholond to the east as far as land once of Jordan Olyuer to the west, as it is divided and enclosed by metes and bounds, which land John had by enfeoffment of Thomas Fraunceis of Colchester and Sabina his wife, to hold from John Boloygne and his heirs in accordance with the liberty and custom of the borough of Colchester for an annual rent to John and his heirs of a grain of pepper at Easter.

Enfeoffment without warranty. Warin son of William of Colchester and John rector of the church of All Saints of Colchester, executors of the will of Adam priest (presbiter), son of Roger of ‘Bery’, have granted (concessimus, vendidimus et hac presenti carta nostra confirmauimus) to Richard of Copford, burgess of Colchester and his wife Richolda, for a sum of ready money, 5 acres of arable in the suburb of Colchester in the field called Bradeston between land of Alice Prentiz on the west side and land called Edrichescroft that Thomas Fraunceys holds for life from the manor of Lexden on the east side, extending from the king's highway that leads from Colchester to the stone cross to the south as far as the meadow of Elias son of John called Chiselmad to the north, which land Adam left to be sold in his will; to hold from the chief lords for the services due freely in accordance with the liberty and custom of the borough of Colchester.

Thomas Fraunceis of Colchester has quitclaimed to Richard of Copford of Colchester and his wife Richolda all right in 2 acres of arable in the suburb of Colchester in the field called Elmfeld between land once of master John of Colchester on the north side and land once Richard Pruet’s of Colchester on the south side, which land Richard and Richolda had by enfeoffment of John Boloygne, rector of the church of St Runwald of Colchester, and the same John bought from Thomas and Sabina his late wife.

John Ode of Colchester, clerk, has granted to Richard le Deygher of Colchester an annual rent of 3s at Easter and Michaelmas by equal portions from John Boyn’s shop in Colchester market situated between a tenement of William Talbot on the east side and a tenement once Ralph Knyght's on the west side, to hold of the chief lords by the services due in accordance with the liberty and custom of the borough of Colchester.

John le Dobere of Stanstead has granted (concessisse) to Matthew son of Robert le Verrer of Colchester an annual rent of 10s from the messuage he inhabits in the suburb(s) of Colchester outside Head Gate of Colchester (ex[tra] portam capitalem Colcestr’) and from the plot (illa placea) of land which he holds by enfeoffment of the said Matthew, lying next to the said messuage, payable at Michaelmas and Easter by equal portions.

Indentored enfeoffment with covenants and warranty. John Pykeman of Colchester, skinner, has granted to Richard Drory of Colchester, draper, the vacant plot of land opposite the tenement he inhabits in the parish of St Peter, Colchester, 5 ells and 8 inches (pollices hominum) in length from Richard’s messuage to John’s solar, and 4½ ells 2 inches in breadth, reserving to himself free access by this plot to the extent of 1¼ ell and 1 inch, and in length from the king’s highway to the hall in which John lives; to hold of the chief lords by the services due. In return Richard will build along the north side of John’s hall a wall on Richard’s own land and a doorway sufficient for access to John’s hall, and in the higher part of that wall Richard will construct at his own cost a window on the north side 1¼ ells wide of sufficient height to admit light to the hall; after this doorway and window are made, John and his heirs will maintain them. Richard will also put in place, and subsequently maintain, a lead gutter the length of John’s hall and solar. Richard also concedes free access to John through Richard’s property as far as Culverlane and from there into John’s tenement.
