What if the performance of a fixed term member of staff is not up to the required standard? Can I just let their contract expire and not renew it?
No, the expiry of a fixed term contract is a dismissal; the correct reason for the dismissal must apply. You must deal with the performance issues in advance of the expiry of the contract in accordance with the Capability Procedure. Failure to do so may result in an extension to the contract to allow the procedure to be followed. Please seek advice from your HR Manager at the earliest opportunity. All fixed term staff are now placed on probation and you must bring any problems to their attention during the probationary period. If staff are dismissed for any other reason than redundancy, and the correct procedures have not been followed, they may have recourse to an Employment Tribunal and as their line manager you may have to attend to explain the reasons for the dismissal.
