Abstract

Discusses the constitutional implications of European Court of Justice case law on the exclusive competence of the Community. Reviews cases on the common commercial policy, fisheries policy and international agreements. Examines the Treaty establishing a Constitution for Europe 2004 and considers whether the constitutional conditions which gave rise to the case law are no longer effective.
